ข้อผูกพันตามมาตรา ๑๑๙ และสัญญาแต่งตั้งผู้ดูแลผลประโยชน์ของกองทุนรวมต้องไม่มีข้อจำกัดความรับผิดของบริษัทหลักทรัพย์ และผู้ดูแลผลประโยชน์ที่มีลักษณะอันไม่เป็นธรรมต่อผู้ถือหน่วยลงทุน ข้อความในข้อผูกพันหรือในสัญญาใดที่มีลักษณะที่ขัดบทบัญญัติตามวรรคหนึ่งให้ตกเป็นโมฆะ
