ผู้จัดการกองทุนส่วนบุคคลใดไม่ดำเนินการตามหลักเกณฑ์เงื่อนไข และวิธีการที่ประกาศกำหนดตามมาตรา ๑๓๔ วรรคสามต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสามแสนบาท หรือทั้งจำทั้งปรับ ถ้าการกระทำความผิดตามวรรคหนึ่งเป็นการฝ่าฝืนมาตรา๑๓๔ วรรคสองด้วย ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินห้าแสนบาทหรือทั้งจำทั้งปรับ
