หมวด ๓ บทกำหนดโทษ

ผู้ใดเคยถูกลงโทษเพราะเหตุกระทำความผิดตามพระราชบัญญัตินี้แล้วครั้งหนึ่ง ถ้าได้กระทำความผิดในบทบัญญัติเดียวกันกับที่เคยถูกลงโทษแล้วนั้นซ้ำอีก ให้ศาลพิจารณาเพิ่มโทษที่จะลงแก่ผู้นั้นอย่างน้อยอีกหนึ่งในสามของอัตราโทษจำคุกหรือเพิ่มโทษอีกกึ่งหนึ่งของอัตราโทษปรับสำหรับความผิดนั้น
