กิจการใดที่กฎหมายบัญญัติให้เทศบาลเป็นผู้ดำเนินการ ถ้ากิจการนั้นอยู่ในพื้นที่เขตจังหวัดที่อยู่นอกเขตราชการส่วนท้องถิ่นอื่น ให้องค์การบริหารส่วนจังหวัดเป็นพนักงานเจ้าหน้าที่ดำเนินการตามกฎหมายนั้น และบรรดาค่าธรรมเนียม ค่าใบอนุญาต และค่าปรับเนื่องในกิจการเช่นว่านั้นให้ถือเป็นรายได้ขององค์การบริหารส่วนจังหวัด
