การให้สัมปทานรายใดถ้าอยู่ในหลักเกณฑ์ที่กำหนดในกฎหมายว่าด้วยการให้เอกชนเข้าร่วมงานหรือดำเนินการในกิจการของรัฐ ให้ปฏิบัติตามกฎหมายนั้นด้วย ให้นำกฎหมายว่าด้วยทางหลวงมาใช้บังคับกับทางหลวงสัมปทานโดยอนุโลม เว้นแต่ที่ได้บัญญัติไว้โดยเฉพาะในพระราชบัญญัตินี้
