ในกรณีที่ผู้โอนมาเป็นตุลาการศาลปกครองหรือข้าราชการฝ่ายศาลปกครองเป็นข้าราชการตามกฎหมายว่าด้วยบำเหน็จบำนาญข้าราชการอยู่แล้วก่อนวันที่บทบัญญัติหมวด ๓ แห่งพระราชบัญญัติกองทุนบำเหน็จบำนาญข้าราชการ พ.ศ. ๒๕๓๙ ใช้บังคับ แต่มิได้สมัครเป็นสมาชิกกองทุนบำเหน็จบำนาญข้าราชการ ให้มีสิทธิได้รับบำเหน็จบำนาญตามกฎหมายว่าด้วยบำเหน็จบำนาญข้าราชการ
