ข้าราชการตุลาการซึ่งดำรงตำแหน่งผู้ช่วยผู้พิพากษาอยู่ในวันที่พระราชบัญญัตินี้ใช้บังคับ เมื่อได้รับการอบรมจากกระทรวงยุติธรรมและการศึกษาอบรมจากสำนักงานศาลยุติธรรมรวมกันเป็นเวลาไม่น้อยกว่าหนึ่งปีแล้ว ให้ได้รับแต่งตั้งให้ดำรงตำแหน่งผู้พิพากษาศาลชั้นต้นได้ โดยไม่นำมาตรา ๑๗ วรรคสอง มาใช้บังคับ
