นิติบุคคลที่รัฐมนตรีจะโอนหุ้นส่วนหรือหุ้นให้จัดการได้ ต้องเป็นนิติบุคคลที่ไม่มีกรรมการหรือพนักงานซึ่งนิติบุคคลนั้นมอบหมายให้เป็นผู้จัดการในการบริหารและจัดการหุ้นส่วนหรือหุ้นของรัฐมนตรีที่มีผลประโยชน์หรือมีส่วนได้เสียกับรัฐมนตรี คู่สมรสของรัฐมนตรี เจ้าหนี้หรือลูกหนี้ของรัฐมนตรี
