จำเลยขุดบ่อเข้าไปในเขตรประธานบัตรจับสัตว์น้ำของโจทย์ แล้วปิดบ่อเสียไม่ยอมให้โจทย์จับสัตว์น้ำได้ ศาลฎีกาตัดสินว่าจำเลยตัดสิทธิในการจับสัตว์น้ำของโจทย์ ซึ่งโจทย์มีอำนาจตามพระราชบัญญัติอากรค่าน้ำศก ๑๒๐ มาตรา ๓ โจทย์มีอำนาจฟ้องเรียกค่าเสียหายได้()
