โจทก์ฎีกา ต่อมายื่นคำร้องขอถอนฎีกาโดยอ้างว่าโจทก์จำเลยได้ตกลงปราณีประนอมกันแล้ว ศาลฎีกาได้สอบถามจำเลยแล้วจำเลยไม่คัดค้าน จึงอนุญาตให้โจทก์ถอนฎีกาได้ และให้จำหน่ายบัญชีจากสารบบ
