จำเลยต้องหาว่าฆ่าคนตายโดยเจตนา ชั้นไต่สวนเจ้าพนักงานพูดว่า"ถ้าจริงก็รับเสียโทษจะเบา" จำเลยจึงให้การรับดังนี้ศาลฎีกาตัดสินว่า คำของเจ้าพนักงานนี้ไม่ใช่เปนคำหลอกลวง เมื่อมีพยานประกอบคำรับสารภาพของจำเลย ลงโทษจำเลยได้
