โจทย์ฟ้องว่าจำเลยทำน้ำสาโทประเภทสุราเถื่อนขอให้ลงโทษ ฎีกาตัดสินยืนตามศาลอุทธรณ์ว่า โจทย์จะต้องสืบให้ได้ความว่า น้ำสาโทนั้นมีลักษณเปนสุราที่ต้องห้ามตามกฎหมาย มิฉนั้นศาลไม่ลงโทษจำเลย ตามฎีกาที่ ๙๖๑/๒๔๕๖,๗๘๘/๒๔๖๗ จึงให้ยกฟ้อง
