ได้ความว่าจำเลยรับหมายเกณฑ์ทหาร ครั้นวันคัดเลือกจำเลยป่วยเปนไข้หนัก มารดาจำเลยจึงไปบอกแก่กำนัน ๆ ได้แจ้งให้คณะกรรมการคัดเลือกทราบในวันคัดเลือกดังนี้ ฎีกาตัดสินว่า จำเลยยังไม่มีความผิด ให้ปล่อยไป
