คดีนี้ทางพิจารณาได้ความว่า จำเลยเอาไม่ตีถูกริมฝีปากโจทก์แตกแล้ววิ่งหนี ศาลเดิมตัดสินปล่อย ศาลฎีกาตัดสินยืนตามศาลอุทธรณ์ว่าจำเลยมีผิดฐานทำร้ายโจทก์ แต่บาดแผลไม่ถึงสาหัสให้ลงโทษจำเลยตาม ม.๒๕๔ ให้จำคุก ๖ เดือน
