คดีนี้เรื่องนี้จำเลยเปนพลทหารบกหนีราชการทหารไปกระทำผิดฐานประทุษฐร้ายร่างกายแลลักทรัพย์ ศาลฎีกาตัดสินเพิ่มโทษจำเลยตามกฎหมายอาญาทหารมาตรา ๕๐ ถ้าจำเลยเห็นว่าไม่ควรเพิ่มด้วยเหตุใดตกเปนน่าที่ จำเลยต้องนำสืบ ในคดีนี้จำเลยหาได้แสดงข้อแก้ตัวอย่างไรไม่
