การยกที่นาให้แก่กัน แม้จะไม่ได้ทำเป็นลายลักษณอักษรก็ดี แต่ผู้ให้ได้มอบที่นาให้แก่ผู้รับใช้อำนาจปกครองมาแต่ผู้เดียวนมนานตั้ง ๒๐ ปี ฉนี้ ที่ย่อมตกเป็นสิทธิแก่ผู้รับตามกฎหมาย
