ศาลฎีกาเห็นว่าสวนยางพารารับเบอร์ไม่ใช่ป่าไม้หรือพืชผลตามความหมายแพ่ง ม.๑๘๖ เพราะฉะนั้นความผิดของจำเลยจึงต้องด้วย ม.๑๘๕ หาใช่ ม.๑๘๖ ไม่ แลตัดสินให้จำคุกจำเลย ๑ ปีตามศาลเดิม
