ได้ความว่า โจทย์ยอมให้เอาไม้ของตนบางส่วนไปปลูกห้องแถวในที่ดินของจำเลย โจทย์หามีกรรมสิทธิเปนเจ้าของห้องแถวรายพิภาษนี้ไม่ เพราะฉนั้นโจทย์ไม่มีอำนาจที่จะฟ้องเรียกเอาค่าเช่าห้องแถวจากจำเลยได้ เพราะโจทย์สืบไม่สมว่าจำเลยได้ยกห้องแถวนั้นให้แก่โจทย์
