ข้อเท็จจริงปรากฏว่า จำเลย ๔ คน สมคบกันล้วงลักธนบัตร์ ๔๓๕ บาท จาก ท. แล้วโดดจากศาลหนีไปดังนี้ ฎีกาตัดสินว่าจำเลยมีผิด ๒ บทคือ ม. ๒๙๓ แล ๒๙๗ แต่ ม. ๒๙ - ๓ เปนบทที่หนัก จึงให้ ลงโทษจำคุก ๑ ปี ตามมาตรานั้น
