จำเลยให้การชั้นไต่สวนผิดกันกับที่ จำเลยเบิกความเปนพยานต่อหน้าศาลแต่คำเบิกความชั้นศาลจะเปนความเท็จหรือจริงโจทก์ไม่มีพยานสืบเลย เพราะฉะนั้นจะสันนิษฐานว่า จำเลยเบิกความเท็จหาได้ไม่ ศาลฎีกาจึงตัดสินให้ยกฟ้องโจทก์
