จำเลยเปนผู้รักษากระบือของโจทย์ที่ได้ถูกศาลยึดไว้ ระหว่างยึดจำเลยได้ใช้แลให้คนอื่นใช้กระบือทำงานหนัก เมื่อโจทย์รับกระบือคืนมาใช้กระบือไม่ได้ ต้องไปเช่ากระบือที่อื่นเสียค่าเช่ารวม ๒๐๐ บาท โจทย์ฟ้องเรียกเงินนี้จากจำเลย ฎีกาตัดสินยืนตามศาลล่างให้จำเลยใช้เงินรายนี้ให้โจทย์
