คำฟ้องและคำให้การ

จำเลยฆ่าเขาตายถึง ๒ คนติด ๆ กันในเวลากลางวันต่อหน้าธารคำนัล เปนการอุกอาจมาก ทำให้ตื่นเต้นหวาดเสียวแก่ประชาชน ถึงแม้จำเลยจะให้การรับก็ดี แต่โจทก์มีพะยานพอลงโทษจำเลยได้

จำเลยให้การรับก็เพราะจำนนแก่พะยาน ไม่เปนประโยชน์แก่คดี ศาลฎีกาจึงไม่ลดโทษให้
