จำเลยฆ่าคนตายโดยความโง่เขลาเข้าใจผิดคิดเชื่อมั่นว่าผู้ตายเปนผีปอบ ทำให้ญาติพี่น้อง จำเลยและคนในหมู่บ้านนั้นตายไปหลายคนแล้ว และเกรงว่าผู้ตายจะทำให้ญาติพี่น้องของจำเลยตายลงไปอีกเช่นนี้ จำเลยมีความผิดตาม ม. ๒๔๙ ไม่ใช่ ม. ๒๕๐ ( ๓ )
