มารดามอบเงินให้บุตร์เปนตัวแทนจัดการให้ผู้มีชื่อกู้ไป ผู้กู้ก็ทราบว่าเปนเงินของมารดาเช่นนี้ ถึงแม้ว่าในหนังสือสัญญาจะมีชื่อบุตร์เปนผู้ให้กู้ก็ดี ตัดสินว่าไม่ทำให้บุตร์เปนเจ้าของเงินนั้น (ดูฎีกาที่ ๑๐๔๑/๑๒๓)
