คดีนี้มีปัญหาว่า เรือนที่ผู้ร้อง ๆ ขัดทรัพย์ว่าเป็นของผู้ร้องโดยผู้ร้องซื้อไว้จากจำเลยแลทำหนังสือซื้อขายกันเองเมื่อวันที่ ๒๙/๒/๖๘ ก่อนประกาศใช้ประมวลแพ่งจะเป็นสัญญาซื้อขายที่ใช้ได้ตามกฎหมายหรือไม่ ศาลฎีกาตัดสินว่า ใช้ได้ให้คืนเรือนแก่ผู้ร้องไป
