คดีเรื่องใดต้องพิจารณาตามหนังสือสัญญาทางพระราชไมตรี ระหว่างกรุงสยามกับฝรั่งเศส พ.ศ. ๒๔๖๗ และคู่ความฎีกาได้แต่ฉะเพาะในปัญหาข้อกฎหมายแล้ว ถึงแม้ว่าศาลล่างทั้ง ๒ ตัดสินกลับกันก็ดี คู่ความก็จะฎีกาได้แต่ในปัญหาข้อกฎหมายเท่านั้น
