ภรรยาที่ไม่มีสินเดิมมาอยู่กับผัวแลไม่มีบุตร์ ถ้าผัวตาย แลมีญาติที่จะรับมรฎกต่อไป ท่านให้คืนสินเดิมให้แก่ญาติตามลักษณมรฎกบทที่ ๒๑ แลภรรยาผู้นั้นไม่มีสิทธิที่จะได้รับมรฎกซึ่งเปนสินเดิมของผัวตามฎีกาที่ ๓๓๕ พ.ศ. ๒๔๖๓ ฯ
