หมวด ๑ บททั่วไป

ในกรณีที่ความเสียหายเกิดขึ้นต่อชีวิต ร่างกาย สุขภาพ หรืออนามัย โดยผลของสารที่สะสมอยู่ในร่างกายของผู้บริโภคหรือเป็นกรณีที่ต้องใช้เวลาในการแสดงอาการ ผู้บริโภคหรือผู้มีอำนาจฟ้องคดีแทนผู้บริโภคต้องใช้สิทธิเรียกร้องภายในสามปีนับแต่วันที่รู้ถึงความเสียหายและรู้ตัวผู้ประกอบธุรกิจที่ต้องรับผิด แต่ไม่เกินสิบปีนับแต่วันที่รู้ถึงความเสียหาย
