ที่ดินของรัฐซึ่งมิได้มีบุคคลใดมีสิทธิครอบครอง รัฐมนตรีมีอำนาจให้สัมปทาน ให้ หรือให้ใช้ในระยะเวลาอันจำกัด ทั้งนี้ ให้เป็นไปตามหลักเกณฑ์และวิธีการที่กำหนดในกฎกระทรวง บทบัญญัติในมาตรานี้ไม่กระทบกระเทือนถึงกฎหมายว่าด้วยการเหมืองแร่และการป่าไม้
