(๒) หรือต้องคำพิพากษาถึงที่สุดให้จำคุกตามความผิดซึ่งได้ระบุไว้ตามมาตรา ๖ (๓) หรือต้องคำพิพากษาในฐานทำความผิดตามพระราชบัญญัตินี้ถึงสองครั้งในปีเดียวกัน
