หมวด ๒ สิทธิในน้ำ

ทรัพยากรน้ำสาธารณะเป็นของส่วนรวม บุคคลมีสิทธิใช้หรือเก็บกักน้ำได้เท่าที่จำเป็นแก่ประโยชน์ในกิจกรรมหรือในที่ดินของตน โดยไม่เป็นเหตุให้เกิดความเดือดร้อนหรือเสียหายแก่บุคคลอื่นซึ่งอาจใช้น้ำนั้น ทั้งนี้ เว้นแต่พระราชบัญญัตินี้ หรือกฎกระทรวง ระเบียบ หรือประกาศที่ออกตามความในพระราชบัญญัตินี้ หรือกฎหมายอื่นบัญญัติไว้เป็นอย่างอื่น
