ให้นายจ้างจัดทำสัญญาจ้างเป็นหนังสือที่มีข้อความถูกต้องตรงกันจำนวนสองฉบับโดยมอบให้ลูกจ้างเก็บไว้หนึ่งฉบับ เพื่อให้พนักงานตรวจแรงงานตรวจสอบ สัญญาจ้างตามวรรคหนึ่ง ให้เป็นไปตามแบบที่อธิบดีประกาศกำหนด ซึ่งอย่างน้อยต้องจัดทำเป็นภาษาไทยและภาษาที่ลูกจ้างซึ่งเป็นคนต่างด้าวเข้าใจได้
