ข้าราชการผู้ใดลาออกไปดำรงตำแหน่งสมาชิกสภาผู้แทนหรือสภาผู้แทนราษฎร แล้วแต่กรณี ก่อนวันใช้พระราชบัญญัตินี้ ถ้าภายหลังกลับเข้ารับราชการใหม่ ก็ให้นับเวลาระหว่างที่ดำรงตำแหน่งสมาชิกสภาผู้แทนหรือสภาผู้แทนราษฎร ในการคำนวณบำเหน็จบำนาญตามกฎหมายที่ใช้อยู่ก่อนวันใช้พระราชบัญญัตินี้
