บทที่ ๑ สภาเทศบาล

สมาชิกสภาเทศบาลให้อยู่ในตำแหน่งได้คราวละสี่ปีนับแต่วันเลือกตั้ง ถ้าตำแหน่งสมาชิกสภาเทศบาลว่างลงเพราะเหตุอื่นนอกจากถึงคราวออกตามวาระหรือมีการยุบสภา ให้เลือกตั้งสมาชิกสภาเทศบาลขึ้นแทนตามกฎหมายว่าด้วยการเลือกตั้งสมาชิกสภาท้องถิ่นหรือผู้บริหารท้องถิ่น สมาชิกสภาเทศบาลผู้เข้ามาแทนให้อยู่ในตำแหน่งได้เพียงเท่าวาระของผู้ซึ่งตนแทน
