ถ้าการกระทำตามมาตรา ๒๑ เป็นการกระทำเพื่อให้บุคคลตามมาตราดังกล่าวไม่ได้รับความปลอดภัย ผู้กระทำต้องระวางโทษหนักกว่าที่บัญญัติไว้ในมาตรานั้นกึ่งหนึ่ง
